When the COVID-19 surge hit New York City hospitals, the Division of Medical Ethics at Weill Cornell Medical College, and our affiliated ethics consultation services, faced waves of ethical issues sweeping forward with intensity and urgency. In this article, we describe our experience over an eight-week period (16 March through 10 May 2020), and describe three types of services: clinical ethics consultation (CEC); service practice communications/interventions (SPCI); and organizational ethics advisement (OEA). We tell this narrative through the prism of time, (...) describing the evolution of ethical issues and trends as the pandemic unfolded. We delineate three phases: anticipation and preparation, crisis management, and reflection and adjustment. The first phase focused predominantly on ways to address impending resource shortages and to plan for remote ethics consultation, and CECs focused on code status discussions with surrogates. The second phase was characterized by the dramatic convergence of a rapid increase in the number of critically ill patients, a growing scarcity of resources, and the reassignment/ redeployment of staff outside their specialty areas. The third phase was characterized by the recognition that while the worst of the crisis was waning, its medium- and long-term consequences continued to pose immense challenges. We note that there were times during the crisis that serving in the role of clinical ethics consultant created a sense of dis-ease as novel as the coronavirus itself. In retrospect we learned that our activities far exceeded the familiar terrain of clinical ethics consultation and extended into other spheres of organizational life in novel ways that were unanticipated before this pandemic. To that end, we defined and categorized a middle level of ethics consultation, which we have termed service practice communication intervention (SPCI). This is an underappreciated dimension of the work that ethics consult services are capable of in times of crisis. We believe that the pandemic has revealed the many enduring ways that ethics consultation services can more robustly contribute to the ethical life of their institutions moving forward. (shrink)

Beyond Consent examines the concept of justice, and its application to human subject research, through the different lenses of various research populations: children, the vulnerable sick, captive and convenient populations, women, people of colour, and subjects in international settings. Separate chapters address the evolution of research policies, implications of the concept of justice for the future of human subject research, and the ramifications of this concept throughout the research enterprise.

Temporal consciousness is philosophically problematic because it appears to have features that cannot be analyzed in a way compatible with the fundamental view of time as a one-dimensional order of events. For example, it seems to be a manifest fact of experience that within a strictly present state of consciousness one can be immediately aware of a succession of events, yet the standard view of time denies that successive events can co-exist, so how can they be given together in a (...) present perceptual state? Such puzzles have occasionally led philosophers to reject scientific or mathematical theories of time. Some time ago C. D. Broad developed a largely unappreciated theory of temporal cognition to cope with these puzzles. In this paper the evolution of Broad’s theory is traced, and it is defended from the misinterpretations of later critics. Finally, it is suggested that a modification of Broad’s theory, which frees it from the trappings of sense-data epistemology, shows it to be compatible with sane current naturalistic approaches to experience that also would need to account for temporal experience within the framework of scientific time. This article employs Umberto Eco’s 2004 novel The Mysterious Flame of Queen Loana as an exemplar of the hypertextuality of Eco’s semiotic theory. Eco’s project illustrates existential semiotics, providing a corrective to Euro Tarasti. For Tarasti signs reveal possibilities for transcendence in the lived world with ‘omnipresent’ meaning in an enunciative dialogue between signs and a semiotic subject. Tarasti’s existential signs are communicative alerts that illuminate a semiotic subject’s journey of transcendence, creating meaning via infusion of signs with signification. This (...) article forgoes Tarasti’s insistence on transcendence. The vitality of existential semiotic signs is displayed through Eco’s hypertextual approach to semiotics manifested in The Mysterious Flame of Queen Loana. Eco’s insights model an existential semiotic, correcting Tarasti’s pragmatically flawed but theoretically significant undertaking. Our rationale for explicating the scope of Tarasti’s work exemplifies an existential disconnect between information accumulation and signification. We present Tarasti’s project due to its fundamental signification for understanding the importance and vitality for existential semiotics. Some recent physiological data indicate that the “subjective timing” of experiences can be “automatically referred backwards in time” to represent a sequence of events even though the earlier portions of associated neurophysiological activity are themselves insufficient to elicit the experience of any sensation. The challenge, then, is to explain how subjects can experience what they do in the reported ways when, if one looked just at certain neurophysiological activity, it would seem that perhaps subjects should report their sensations differently. The (...) phenomenon has seemed sufficiently remarkable to the neurobiologist John Eccles to count as evidence for mind-body dualism. This dualistic interpretation has resulted in a spirited attack by P. S. Churchland on both the physiological research and the dualistic interpretation. Her attack resulted in an equally spirited defense of the research by the primary investigator, B. Libet, where he reaffirmed his more guarded interpretation that “the temporal discrepancy creates relative difficulties for identity theory, but that these are not insurmountable”. In turn, Churchland has defended her criticism of Libet's research so that, for her, Libet's hypothesis remains “infirm and unconfirmed”. (shrink)

Nearly one year has passed since the release of the Committee’s final report and recommendations, and it seems an appropriate time to invite discourse and reflection on the influence and impact of the Committee and (...) its efforts. Our intent is to advance understanding of the Committee and its work, its place in the evolution of bioethics and public policy, as well as the broader legacy of restoring trust in the conduct of human subjects research.In 1993, President Clinton and Secretary of Energy Hazel O’Leary initiated an investigation of America’s involvement in radiation experiments on its citizens during the Cold War. The investigation resulted in the appointment of the Committee in January 1994. Some issues raised by these radiation experiments were brought to the attention of the nation by revelations contained in a Pulitzer Prize-winning series of newspaper stories about plutonium injections carried out by the government on allegedly unsuspecting subjects during the Cold War. The Committee faced a broad mandate, which included piecing together the history of Cold War radiation experiments and human subjects research, as well as recommending remedies for past wrongs and mechanisms to ensure that such wrongs could not be repeated in the future.This issue of the Journal consists of articles and accompanying commentaries on historical, philosophical, policy, and political aspects of the Committee’s work that are important to bioethics. A recent version of the causal theory of time makes crucial use of a concept of the genidentity of events when it attempts to define temporal betweenness in terms of empirical, physical properties. By presenting and discussing an apparent counter-example it is argued that the role of genidentity in an empirical theory of time is problematic. In particular, it may be that the temporal behavior of objects is used to decide which events are genidentical, and, if so, the definition of (...) temporal betweenness is circular. On the other hand, though there are strategies for avoiding the charge of circularity, in certain hypothetical situations the definition may yield inconsistent temporal orders. Then, the definition would have to be supplemented by a choice of temporal orders, and this choice may introduce an element of conventionality into the causal theory of time. (shrink)

Evidence that confirms a scientific hypothesis is said to be ‘novel’ if it is not discovered until after the hypothesis isconstructed. The philosophical issues surrounding novel confirmation have been well summarized by Campbell and Vinci [1983]. They write that philosophers of science generally agree that when observational evidence supports a theory, the confirmation is much stronger when the evidence is ‘novel’... There are, nevertheless, reasons to be skeptical of this tradition... The notion of novel confirmation is beset with a theoretical (...) puzzle about how the degree of confirmation can change without any change in the evidence, hypothesis, or auxiliary assumptions... There have not yet appeared any obviously satisfactory solutions to these problems Much of the literature on novel confirmation relies on the Bayesian analysis of conditional probabilities. Let H represent a hypothesis, E an event that confirms the hypothesis, and B some relevant background information. Denote by Pr the conditional probability of x given y. There are various plausible measures of the degree of support that E lends to H. Among these are: Degree of support = Pr Degree of support = Pr – Pr Degree of support = Pr – Pr Degree of support = Pr – Pt In the work cited, Campbell and Vinci offer a somewhat more involved Bayesian interpretation. Formula is discussed by Gardner [1981] who points out that under this formulation there can be no role for novelty. 'The function Pr contains no third slot in which to insert a temporal relation between the invention of H and the inventor's learning E. Obviously, then, this relation could not possibly affect E's support of H.' Formula, on the other hand, suggests a role for novelty. Bayes's Theorem allows us to rewrite the formula as Degree of support = Pr x [Pr – 1] We can use 1/Pr as a measure of the novelty of E. Then shows that the degree of support increases with novelty of E. In the paper already cited, Campbell and Vinci discuss shortcomings of this analysis. Formula expresses an alternative offered by Howson [1984]. In that formula, Pr represents the probability of H assuming that only B – {E} is known. This allows for the possibility of non-novel facts generating support for hypotheses. Niiniluoto [1984] argues for a variant along the lines of, in which we account for the possibility that the theorist was unaware that his hypothesis entails E. One problem in deciding among these approaches is that the choice of a definition for the degree of support appears arbitrary. What kind of argument could justify the choice of one definition over another? It is our position that there can be no basis for addressing this question in the absence of an explicit model of the process by which hypotheses are generated. Only in the presence of such a model can the various conditional probabilities be given meaningful interpretations. We provide such models in Sections 1, 2 and 4. The simple model of Section 1, incorporating strong assumptions, yields the conclusion that novelty is irrelevant. When these assumptions are relaxed in the later sections, novelty becomes relevant for a variety of reasons. It is at least potentially the case that scientists have more information about their own abilities than is publicly available, and this information might influence their decisions about whether even to attempt novel prediction. If this is so, then it should be incorporated into the model of hypothesis generation. This requires an explicit discussion of how scientists respond to incentives and how the incentives themselves evolve, which in turn takes us into the realm of economic theory. Important revisions and additions to the contemporary objectives of acceptance rules result from construing a theory of warranted inductive inference to presuppose an account of adequate scientific explanations. We conceive the objects of acceptance rules to be the best of competing scientific explanations. Our primary interest is to show how to construct an analysis of competing explanations. Hence our specific investigation concerns the interrelations between the criteria of adequacy for scientific explanations and the definitions of the modes of competition between (...) explanations. The verb λάω is attested in two passages of early epic poetry, Homeric Hymn to Hermes 360, where the infant Hermes is hiding in a dark cave, and τ 229 ff., of a hound seizing a fawn on the brooch of Odysseus. Of the several meanings suggested by the ancient lexicographers for λάω, seeing, gazing, or crying, screeching would suit. These senses recur in their explanations of, with gripping or devouring as additional possibilities. The most extensive modern treatment of λάω (...) is by Leumann, who explains it as a present falsely formed from the perfect λ⋯ληkα, and originally intended to describe the cry of a bird of prey. The unfamiliarity of the form led to its being associated later on with the sharp-sightedness of such birds, as well as with the bark of a hound fastening on its quarry. (shrink)
